Responsibilities

1. Title Clearing and Curative Work

Reviewing the preliminary title report or commitment to identify and resolve "clouds" on the title. This includes ensuring old mortgages are discharged, tax liens are paid, and any legal judgments or heirship issues are resolved before the closing date.

2. Preparation of Closing Disclosures (CD) and ALTA Statements

Collaborating with mortgage lenders to finalize the financial breakdown of the transaction. The closer is responsible for balancing the "ledger"—ensuring that the buyer's credits and debits match the lender's figures and the seller's expected net proceeds.

3. Coordination of Escrow Funds

Managing the receipt and disbursement of all transaction funds. This includes verifying incoming wire transfers for down payments, paying off the seller’s existing mortgage, and cutting checks for real estate commissions, property taxes, and recording fees.

4. Facilitating the Closing Appointment

Acting as the lead facilitator during the signing. This involves explaining complex legal and loan documents (like the Note, Deed of Trust, and Affidavits) to buyers and sellers, ensuring every signature is captured correctly, and notarizing the necessary documents.

5. Post-Closing Compliance and Recording

Ensuring the transaction is legally finalized after the "table" meeting. This involves sending the signed loan package back to the lender, submitting the Deed and Mortgage to the county clerk for public recording, and issuing the final Title Insurance policies.
